Acceptable Use Policy

This Acceptable Use Policy (“AUP”) shall govern the use of the systems, websites, networks, products, and/or services (collectively, the “Services”) provided by Converge Information and Communications Technology Solutions, Inc. (“Converge”) to its subscribers and other users of our various Services (collectively, “Subscribers”) to enable us to provide our Subscribers with secure, reliable and quality services.

In General: The Services must only be used for legitimate purposes and in a manner that is consistent with the approved use. The Subscriber is prohibited from using the Services to undertake, transmit, distribute, or store any content that:

(a) is illegal under any applicable laws or regulations;
(b) could be harmful or could adversely affect the delivery of Converge’s Services to its subscribers; and
(c) could subject Converge to any legal action.

Subscribers are likewise prohibited from directly or indirectly assisting or allowing another party to commit a violation of any provisions of this AUP.

Compliance with Applicable Laws and Regulations: Users of our service are expected to comply with all relevant laws relating to Information and Communications Technology (ICT), including among others, Republic Act No. 10175 or the “Cybercrime Prevention Act of 2012”, and Republic Act No. 11930 or the “Anti-Child Online Sexual Abuse or Exploitation of Children (OSAEC) and Anti-Child Sexual Abuse or Exploitation Materials (CSAEM) Act”.

Prohibited Activities: Subscribers shall not engage in any of the following prohibited activities:

Creating, distributing, possessing, or accessing explicit material involving minors or engaging in online conversations or activities with the intention of luring minors into sexual exploitation, abuse, or organizing, promoting, or participating in cybersex.
Taking someone's personal information or using it for fraudulent purposes, such as phishing, identity theft, financial exploitation, or any activities related to, or would constitute fraud, unlawfully or unauthorized access to computer systems, networks, or data, as well as activities like hacking websites or posting defamatory statements or false information about individuals or entities online can lead to legal consequences.
Engaging in online harassment, cyberbullying, or threats against individuals and shall not engage in sending unsolicited emails or messages for commercial purposes without consent.
Employing activities such as uploading or downloading copyrighted materials without authorization, such as movies, music, or software, or engaging in distributing malware, or viruses, engage in activities that disrupt or degrade the ISP's network or services, such as running network scanning tools.
Directly or indirectly committing or consenting to doing any analogous activities with the preceding and succeeding paragraphs and/or other prohibited activities as cited in the aforementioned relevant laws and regulations.
Conduct unauthorized monitoring of network traffic or engage in activities that compromise the privacy of others.
Engage in activities that disrupt or degrade the ISP's network or services, such as running network scanning tools.
Using the Services to facilitate, engage, or assist in any illegal activities, including any form of trafficking or fraud.

Privacy: Converge encourages our Subscribers to be responsible for protecting the security of their network and the privacy of their information and account details, including their username and password combination, and any other credentials for identification.

Subject to the terms of our Privacy Policy, Converge makes no representations or warranties as to the security and integrity of any data or information a Subscriber communicates via the Service or over the Internet, including any data or information transferred via any server designated as "secure." Converge further disclaims any responsibility for the security and integrity of such data or information.

Reporting Violations: Subscribers who suspect or witness any violations of this AUP are required to report such incidents to the appropriate authorities and Converge for appropriate actions immediately after the discovery thereof.

Consequences of Violations: Violations of this AUP or relevant laws may result in the suspension or termination of the subscribers' access to the Services. Converge reserves the right to undertake any legal actions and other remedies as provided by law and other regulations.

Amendment of AUP: This AUP may be amended or updated by Converge as necessary to reflect changes in laws and/or technology. It is the responsibility of the Subscribers to regularly review this AUP for any updates.

By using the Services, you acknowledge that you have read, understood, and agreed to comply with this Acceptable Use Policy and all applicable laws and regulations applicable to our Service.
